Terms and Conditions

All services purchased from Optimum fitness must be preceded by the applicant acknowledging, by way of completing a PAR-q form, that he/she has no physical limitations preventing him/her from participation. All applicants under the age of 18 years must have
consent, in written form, from a parent or guardian. The applicant also agrees to abide by the rules and regulations of the studio and
acknowledges that these rules and regulations may change from time to time. Furthermore, all applicants release Optimum fitness, its
owners and manager of all liability regarding any loss or damage to personal property. If purchasing packages that require payments to be made in instalments, the applicant agrees to approve such instalments be made by Credit card or Debit card on the dates as predetermined in the services contract.

Registration & Purchase:
To register or purchase from the optimum fitness online booking system, you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete.

Class Booking 
General

  1. All group exercises classes can be booked online for optimum fitness. Booking is based on a "first come, first served" basis and there are no preferential booking windows for specific membership types.

  2. As a service standard we recommend that you book online in advance to guarantee your place in the class. Members who choose not to book in advance do so at their own risk. Unreserved places are awarded on a 'first come, first served basis'  to drop in's and preferential treatment will not be given.

  3. Bookings can be made up to 30 days in advance.

  4. Each member is entitled to book classes for themselves and one guest. 

  5. Members will receive an automated confirmation email or text of successful booking. We advise that this is retained as proof of booking.

  6. Advance booking online requires an active internet connection or access to a computer or device which will allow such connections. Bookings are made via the secure online member's area on the Optimum Fitness website. You can log in to the members area at www.optimumfitness121.co.uk

  7. If a member does not have the ability to book a class online then they may book via text message or in person at the fitness studio during regular opening hours.  We do not operate a telephone booking system. All other conditions of the online booking system apply.

  8. By accessing and using the class booking system you indicate that you accept the terms and conditions of the website.


Cancellations

  1. If a booking needs to be cancelled then this can be completed no later than 24 hours before the class start time.

  2. You will only be permitted to cancel by telephone if your class was booked originally at the fitness studio. Classes booked online must be cancelled online through the website.

  3. On occasion it may be necessary for a class to be cancelled or for the class type, instructor or location to be changed. Optimum Fitness reserves the right to do this at any time. Where possible advance notice to those members who have booked the affected class will be given, however this may not always be possible.

  4. If a class is not cancelled (no show) or cancelled with less than 3 hours notice the member will lose their advance booking rights for the period of that class.

  5. Chargeable classes that are not cancelled will result in the class fee being charged or loss of a session.

  6. General Managers will monitor abuse on a monthly basis through an exception report. Members who continually book then cancel may receive a warning or lose their advance booking rights.

  7. Members on the reserve list will be placed on the register if a space becomes available in the order of reservation and will receive an e-mail confirming this.

  8. All private training sessions booked, require 24 hours notice from the member for cancelation to avoid penalty. If a session is cancelled with less than 24 hours notice the full amount of that session will be charged to the member.


Privacy Policy
Your Privacy
1. Optimum Fitness respects your privacy and pledges to maintain the confidentiality of your personal information. All personal information
    you share with us is maintained in accordance with the Personal Information Protection and Electronic Documents Act (2000).
2. Optimum Fitness will release any information that is required to be released by law or court order. In exceptional circumstances it may
    be necessary that we disclose your personally identifiable information if we believe, in good faith, that disclosure is otherwise
    necessary or advisable to protect Optimum Fitness interests. We will seek to ensure that any proposed disclosure is required in the
    circumstances and then ensure that we disclose only the information that is required.

Use of Your Information
3. Optimum Fitness obtains most of our information through the signing of waivers and completion of Par-Q forms. With your consent we
    may also obtain personal information about you from third parties. This may include parents, guardian, coaches or whoever is
    registering you in a program and paying for your registration. Use of your personal information for any purpose other than those
    outlined or the release of such information by parties outside of Optimum Fitness or its affiliates will take place only under the following
    circumstances:
4. When you give consent – We will disclose your personal information when you have given consent.
    Under no circumstances do we sell participant or personal information to others. Please note that we will not share health
    information that may have been provided in connection with a program, program withdrawal or request for refund. With your
    consent, we may use certain information to provide you with information about Optimum Fitness and programming. This
    consent is optional and you can decide to withdraw it at any time. Information collected by Optimum Fitness about its users is used
    internally by authorized employees of Optimum Fitness for following reasons: To process payment, register you in the program of your
    choice, update you when required of any possible changes of the planned services at Optimum Fitness, determination of those areas,
    features, and services that are valued the most and found most helpful. Also, we collect information to determine the appropriate
    participation in the activities and services provided at the Optimum Fitness and on our site.

Photos/Videos

  1. Optimum Fitness will often take photos and video of it’s members during workouts or special events, and may choose to  post the photos/videos on the website or social media sites. The member agrees that his or her imagery and likeness are approved for Optimum fitness to use for any purpose pertaining to the general nature of the industry. There is no compensation for any imagery or likeness used in any form whether promotional or commercial. If you are against or unhappy about your personal image on camera then forward a letter to the management of Optimum fitness. 

Liability Waiver

  1. Optimum fitness classes may involve strenuous physical activity, including but not limited to, interval training, muscular strength, endurance training, cardiovascular conditioning and aerobic training.

  2. To take part in the class, participants should be in good medical condition and not suffer from any known disability or condition that would prevent or limit participation in the class. 

  3. Enrolment and participation in the class is voluntary and in no way mandated by ‘Optimum fitness.

  4. Participation in the class therefore is on the understandings that if any injuries occur as a result of attendance, optimum fitness and its instructors are` released from any liability now or in the future for conditions that may be obtained from participation.

Conduct

  1. Any Member must use the Facilities in accordance with the advice provided by any representative of Optimum Fitness and/or notices displayed.

  2. A Member must not abuse the Facilities and the Member will be responsible for any wilful damage or damage caused by negligent use.

  3. All Member's and all persons are required to behave in a reasonable and courteous manner so as not to be offensive or cause disturbance to the quiet enjoyment of the studio by other Members and/or their guests.

  4. Member's may be terminated by Optimum Fitness for violation of the studio Rules or for conduct reasonably deemed by Optimum Fitness to be detrimental to the welfare, good order or character of the studio and its Members. 

  5. Optimum Fitness reserve the right to retain a proportion of any fees paid by the Member relating to use of the studio prior to termination and any reasonable costs incurred as a result of termination.

  6. Appeals against any termination of the Member Agreement must be submitted in writing within 7 days of the termination of the agreement addressed to Customer Services or management at the studio Address. Any appeal will be dealt with as quickly as possible but in all cases
    within 28 days of receipt of the letter of appeal.

Miscellaneous

  1. Smoking within the studio and its premises is strictly prohibited.

  2. Written notices that are required to be given under this Agreement by Optimum Fitness will be sent by second class post to the address stated on the Membership Agreement (or such other address which you will notify in writing from time to time). All such notices will be deemed to have been received by the Member three days after posting. All other notices required to be given by Total Fitness will be placed in a prominent position within the studio.

  3. Membership of Optimum Fitness allows access and use of the Facilities only.

  4. Optimum Fitness reserves the right to alter, change, add to, reduce or cease various Facilities and to utilise the Facilities for special events, private parties, or other activities it may deem desirable upon giving such reasonable notice as possible in the circumstances.

  5. Optimum Fitness may, on a temporary basis, withdraw use of part of the Facilities at the studio due to the failure of services or for the purpose of undertaking necessary maintenance or repair work or for the replacement of Facilities. Any work will be completed as quickly as practicable. Compensation will not be given for such closures.

  6. In the event of major reconstruction of the premises, every effort will be made by Optimum Fitness to ensure any inconvenience is kept to a minimum and that the Facilities are available for use whenever possible. Membership will not, in such circumstances, be suspended and the Member may as permitted under the Agreement.

  7. The member is responsible to inform Total Fitness of any changes to their personal details including; address, contact phone number or email address.
